Sentencing

Oregon felony sentencing is controlled by the Oregon Sentencing Guidelines, unless those guidelines are overridden by Ballot Measure 11, repeat-property offender law, or a dangerous-offender sentence. Federal convictions are controlled by the federal sentencing guidelines, which are both more complex and usually carry more severe sentences.

Most of the times when I have convinced an appellate court to review and reverse based on an unpreserved error, it was a sentencing error. Some very good trial attorneys don’t understand the intricacies of the sentencing system, and that can lead to illegally-long sentences.
